Extensive experience from thirty five years active involvement in management and construction, performing financial risk analysis, contract negotiations, mitigation of subcontractor disputes, and project facilitation. Strong expertise in the areas of job site accident research, analysis of foundation failures, stucco wall systems, soil subsidence, water intrusion, mold mitigation management and personal injury claims with exceptional skills in systems analysis. Equally strong background as litigation strategist in coordinating the efforts of engineers, consultants, subcontractors and building officials. Proven superior initiative in resolving complex problems requiring material testing and computer data base analysis. Special Master for California Superior Court. Alternative dispute resolution skills as trained conflict mediator and former national panelist arbitrator (AAA).

Published writer, author, industry spokesman, university lecturer and seminar leader for numerous national construction industry conventions. RATE SCHEDULE AND TERMS OF ENGAGEMENT

Retainer- Nonrefundable:

Retainer amount based as case details dictate, Please remit with initial paperwork.

Consulting, Dispute Resolution, Risk Investigation and Analysis, Research, Review and Travel:

Arbitration, Mediation (1 Day Minimum)
Crisis/Defect analysis, Project expediting, Photo documentation, Document review and research, Reports, Meetings. $325.00/hour. Travel is computed from client's office.

Testimony at Depositions and Trial (Four Hour Minimum) $450.00 /hour
Mediation Services, Dispute Review Board, Project Neutral. $450.00 /hour

Reimbursable Expenses:

Accommodations billed on per diem rate. ($100 per day for room accommodations)
Clients shall reimburse W. F. Dexter Co. for incidental expenses incurred at actual cost. Reimbursable expenses include, but are not limited to, air travel, car rental, photocopying, postage.

Billing:

Principal/Assistants/Costs: 30-Day Cycle, Due in 30 Days.

This Schedule of Fees constitutes the financial terms of the engagement between the parties as follows:

• WFD will conduct review and analysis of the issues at the client's specific request as described in the written assignment.

• As a consulting firm, WFD is acting solely in an advisory capacity; WFD cannot and will not make decisions on behalf of the client.

• Fees for this engagement are described in the Rate Schedule above. (available for download on the web www.wfdexter.com ).

• It is WFD policy to work directly for the attorney. WFD will direct all correspondence, reports and billing to the attorney/client's office. Although the party may issue payment to WFD directly, the law firm is ultimately responsible for the payment of all invoices.

• The opinions and advice of WFD will be based on such information as the client makes available, and WFD does not assume responsibility for its accuracy or the accuracy of assumptions based thereon.

Payment of retainer and/or fees constitutes full acceptance of the terms herein.
